1. Who These Terms Apply To

These Terms apply to website visitors, resource subscribers, lead magnet users, form submitters, call bookers, and anyone who interacts with BBB Marketing through this website.

These Terms do not replace a signed proposal, service agreement, statement of work, invoice, or separate payment terms.

If a separate written agreement exists between you and BBB Marketing, that agreement controls the paid service relationship.

2. Website, Resources, Forms, and Booking Calls

BBB Marketing provides this website to share information about our services, resources, positioning, partner ecosystem, and educational content.

You may use the website for lawful purposes only.

You may submit forms, download resources, join our email list, book calls, or contact us if you are interested in learning more about BBB Marketing.

Submitting a form or booking a call does not create a client relationship.

3. No Client Relationship Until Accepted

A client relationship with BBB Marketing begins only when both sides agree to work together through a written proposal, service agreement, statement of work, invoice, or other accepted commercial agreement.

BBB Marketing may choose whether to accept or decline any project, client, partnership, or inquiry.

We primarily work with Shopify health and wellness brands using Klaviyo or moving to Klaviyo.

4. Free Resources and Educational Content

BBB Marketing may provide free resources, lead magnets, playbooks, checklists, reports, templates, emails, articles, videos, or other educational materials.

These resources are provided for general education and business information.

They are not a guarantee of results.

They are not a substitute for a custom strategy, client engagement, legal review, regulatory review, financial advice, or medical compliance advice.

5. Use of AI-Assisted Processing

BBB Marketing may use AI-assisted tools and internal systems to help process information you submit, understand your business context, prepare for calls, organize recommendations, improve resources, review website performance, and support a better customer experience.

This may include processing form answers, website details, Shopify or Klaviyo context you choose to share, business goals, messages, and other information submitted through the website or during communication with BBB Marketing.

BBB Marketing remains responsible for how we use these tools in our own business processes.

6. Health, Legal, Regulatory, and Financial Disclaimer

BBB Marketing works with brands in the health and wellness space, but we do not provide medical, legal, regulatory, financial, tax, or compliance advice.

Any marketing, Klaviyo, deliverability, ecommerce, or retention guidance we provide is business and marketing guidance only.

You are responsible for ensuring your products, claims, ads, emails, website content, offers, and business practices comply with applicable laws, platform rules, industry standards, and regulatory requirements.

7. User Submissions

If you submit information to BBB Marketing, you confirm that the information is accurate to the best of your knowledge and that you have the right to share it.

You allow BBB Marketing to use submitted information to review your inquiry, prepare for calls, send resources, follow up, assess fit, improve our website, and communicate with you.

You should not submit confidential, sensitive, regulated, or proprietary information unless you are comfortable sharing it with BBB Marketing.

The BBB Marketing website, copy, frameworks, resources, templates, playbooks, systems, visuals, page structures, strategy documents, and related materials are owned by BBB Marketing or used with permission.

You may not copy, resell, redistribute, publish, repackage, license, or present BBB Marketing materials as your own without written permission.

10. Acceptable Use

You agree not to misuse the website or resources.

You may not attempt to damage, disrupt, scrape, reverse engineer, spam, overload, or interfere with the website, forms, tracking systems, booking tools, or other infrastructure.

You may not use BBB Marketing materials for unlawful, misleading, harmful, or unauthorized commercial purposes.

Paid BBB Marketing services are governed by the applicable proposal, invoice, service agreement, payment terms, statement of work, or other written agreement accepted by both sides.

Refunds, payment schedules, cancellation terms, delivery terms, and project-specific rules are handled through the applicable payment terms or written agreement.

12. No Guaranteed Results Unless Stated Separately

BBB Marketing may share case studies, results, guarantees, client outcomes, benchmarks, and performance examples.

These are not promises that every brand will achieve the same result.

Any specific guarantee applies only if it is clearly included in a written proposal, service agreement, statement of work, or accepted commercial agreement for that specific client relationship.

13. Limitation of Liability

To the fullest extent permitted by law, BBB Marketing is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from your use of the website, resources, forms, lead magnets, booking tools, or educational content.

Your use of the website and free resources is at your own discretion.

14. Indemnification

You agree to defend, indemnify, and hold BBB Marketing harmless from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, unlawful conduct, or use of BBB Marketing resources in a way that violates another party's rights or applicable law.
